2. Title Of Goods

2.1 It is a condition of sale that all goods supplied by Kangaroo Hills will remain the property of Kangaroo Hills and the title of such goods shall not pass to the purchaser until they have been paid for in full, including any interest due.
2.2 In the event of the purchaser defaulting on payment for any reason, the purchaser will pay all costs, expenses and realisation including legal costs.

3. Shipping Discrepancies

3.1 Upon receiving payment for online orders we will normally send your order to you within 28 working days for furniture items and 5 working days for other smaller items.
3.2 You agree that proof of delivery supplied by the delivery company is sufficient evidence to establish that goods have been received and that you are happy with the goods, it is up to the customer to ensure the goods are suitable upon delivery.
3.3 You must inform us immediately if the goods are damaged in transit so that, if the courier was arranged by us, we can make a prompt claim against the delivery company and address the problem. Please keep the packaging and record any photographic evidence where possible, in order to prove damage occurred during delivery. If delivery is by specialist furniture courier it is the responsibility of the purchaser to point this out to the courier company PRIOR to signing for the goods. If you are collecting or organising your own courier, any damage once the goods have left us will be your responsibility and therefore inspection before removal of goods is essential.
3.4 If your goods have not arrived within the agreed delivery period and/or you suspect that the shipment may be lost, please contact us immediately.
3.5 Any shortages or errors in shipments must be notified to Kangaroo Hills in writing within 3 working days of receiving the shipment.

4. Returned Product

4.1 Incorrect goods – If for any reason you have ordered the incorrect goods we offer a 14 days (from delivery date) refund policy, subject to the goods being returned in unused, condition as sent, with the original packaging still intact, if relevant, and as long as we are notified within 24 hours of delivery. Any returns after 14 days are at the Company’s discretion and a restocking fee of 15% may be charged. After 28 days no returns will be accepted, even if we are notified within 24 hours.
4.2 If any goods are specially ordered, made to customer specifications or personalised, the order cannot be cancelled or returned.
4.3 Faulty goods – The purchaser may return the goods for a refund if the goods:
– are faulty or damaged, for example in transport (except where organised by the customer) or faulty if described as perfect or new and unused, but our items are not new, have been preloved and wear and tear must be expected. If the purchaser wishes to buy perfect or new items they are recommended not to purchase listed items unless they are detailed as new or perfect, do not match how they were described and pictured or are different to the ones ordered.
4.4 It is the responsibility of the customer to ensure the goods are correct and undamaged except for antique wear and tear and any fault mentioned or pictured. Any incorrect or damaged goods must be reported to info@kangaroohills.com within 24 hours of receipt of delivery without exception.
4.5 If any goods are returned for credit after 14 days from date of purchase, a handling charge of up to 15% may be levied.
4.6 When returning goods, the purchaser is responsible for the repackaging of the goods and they are in your care until they arrive at our premises. Provision of proof of posting / delivery may be required.
4.7 Kangaroo Hills regret that postage/packaging/insurance costs are non-refundable, unless goods received are received in error. Postage and packing is the customer’s responsibility when returning items for a refund.

5. Privacy Policy

5.1 Kangaroo Hills do not disclose buyers’ information to third parties other than when order details are processed as part of the order fulfilment. In this case, the third party will not disclose any of the details to any other third party. Unless otherwise agreed with you, we will only collect basic personal data about you, which does not include any special categories of personal information about you (often known as ‘sensitive personal data’). This information does, however, include the likes of your name, address; email address and, if on behalf of a company, your job title.
We need to know basic personal data in order to provide you with the services you have engaged us to provide, if you do not provide this information then we will be unable to provide the services you have requested. We will not collect any personal data from you that we do not need.
All the personal data we hold about you will be processed by our staff in the United Kingdom and no third parties will have access to your personal data unless there is a legal obligation for us to provide them with this. We take all reasonable steps to ensure that your personal data is processed securely.
We will generally keep your personal data for a minimum of 6 years, after which time it will be destroyed if it is no longer required for the lawful purpose(s) for which it was obtained. If you consent to marketing, any information we use for this purpose will be kept with us until you notify us that you no longer wish to receive this information.
Should you choose to contact us using the contact form on our Contact us page, none of the data that you supply will be stored by this website or passed to / be processed by any of the third party data processors. Instead the data will be collated into an email and sent to us over the Simple Mail Transfer Protocol (SMTP). Our SMTP servers are protected by SSL meaning that the email content is encrypted before being sent across the internet.

6. Illustrations & Specifications

Website and other illustrations and specifications are subject to alteration without notice. They are not binding and are only intended to represent the type of Goods offered as products may not conform to them in detail. Whilst every effort has been made to ensure the accuracy of data given, we accept no liability in respect of any contingency arising from any errors or omissions. Items are used and have signs of age, wear and tear and the images may not always show the full extent of this. Goods are dated by external professionals and in-house experience. Wood is identified by external professionals and in-house experience. Kangaroo Hills accepts no responsibility for incorrect dating, wood identification or origination any items.

7. Limitation & Exclusion Of Liabilities

7.1 The Company’s obligations and liabilities to the buyer in respect of the goods shall be limited to:
(i) those set out expressly herein
(ii) those implied (as to the title etc.) by Section 12 of the Sale of Goods Act 1994 and the Consumer Rights Act 2015
